Public terms of service

These Terms of Service govern access to the Nevigen.com website (the “Site”), user accounts, software products, services, materials, and other services provided through the Site.

By using the Site, creating an account, signing in through third-party services, or purchasing software products or services, you confirm that you have read these Terms and agree to comply with them.

If you do not agree to these Terms, please stop using the Site and its services.

1. General Provisions

Nevigen.com provides software products, extensions for Joomla and JoomShopping, documentation, technical support, development services, integrations, and other web development-related services.

Certain products and services may be subject to additional terms published on the Site.

In particular, software products may be subject to:

  • the License Agreement;
  • Delivery Terms;
  • Exchange and Refund Terms;
  • support terms specified on the relevant product page.

If these Terms conflict with specific terms applicable to a particular product or service, the specific terms for that product or service shall apply.

2. User Account

Registration or authentication may be required to use certain features of the Site.

Users must provide accurate information and are responsible for keeping the credentials used to access their account secure.

Users are responsible for actions performed through their account where such actions became possible because the user shared their access credentials with third parties or failed to adequately protect those credentials.

If you become aware of unauthorized access to your account, please contact Nevigen.com support as soon as possible.

3. Authentication Through Third-Party Services

The Site may allow users to register or sign in using third-party services, including Google.

When such authentication is used, Nevigen.com may receive information from the relevant service that is necessary to create or identify a user account, such as the user's name, email address, and account identifier.

The information received is processed in accordance with our Privacy Policy.

Use of third-party services is also subject to the terms and policies of the respective third-party providers.

Nevigen.com does not receive or store the user's password for their Google account or any other third-party service.

4. Software Products

Software products distributed through Nevigen.com are protected intellectual property and are provided to users under the terms of the applicable license.

Purchasing a software product does not transfer exclusive rights or ownership of the software source code to the user.

If a product is licensed for a specific domain, the user may use that product only in accordance with the terms of the purchased license.

5. Purchase and Delivery of Digital Products

After successful payment for a digital product, access to the product and, where applicable, a license key will be provided through the user's account or by another method specified on the Site.

Users are responsible for verifying the accuracy of their email address, domain name, and any other information provided when placing an order.

6. Refunds

Refunds and cancellation of purchased digital products are governed by the separate Exchange and Refund Terms.

Before purchasing a software product, users should review its description, system requirements, compatibility information, and demo version, where available, and contact support if additional information is required.

7. Development and Integration Services

Nevigen.com may provide custom development services, website modifications, extension development, integrations with external services and APIs, software configuration, and other technical services.

The scope of work, price, deadlines, and other material terms are determined separately for each order.

Unless otherwise expressly agreed, changes to requirements after the scope of work has been agreed may result in changes to the price and completion schedule.

Integrations that rely on third-party APIs and services may depend on the continued operation of those third-party services. Nevigen.com is not responsible for changes to, restrictions on, or discontinuation of third-party APIs or services.

8. Technical Support

The availability and duration of technical support may vary between software products and are specified on the relevant product page.

Technical support may include assistance with installation, configuration, and use of the product within its stated functionality.

If an issue is caused by third-party software, source code modifications, server configuration, incompatible extensions, or specific characteristics of the user's website, diagnostic or adaptation work may be provided separately.

9. Acceptable Use

When using Nevigen.com, users must not:

  • violate applicable law or the rights of third parties;
  • attempt to gain unauthorized access to the Site, servers, or accounts of other users;
  • interfere with the normal operation of the Site;
  • perform automated activities that place an excessive load on the Site infrastructure;
  • use the Site to distribute malicious software;
  • circumvent licensing or software protection mechanisms;
  • distribute purchased software products in violation of the applicable license terms;
  • use the Site for fraudulent or other unlawful activities.

In the event of a material violation of these Terms, access to certain Site features may be restricted or terminated.

10. Intellectual Property

Unless expressly stated otherwise, software code, graphics, documentation, text, interface elements, trademarks, and other Nevigen.com materials are protected by intellectual property laws.

Publication of materials on the Site does not transfer any exclusive intellectual property rights in those materials to users.

The use of software products is governed by the applicable License Agreement.

11. Third-Party Services

Certain Nevigen.com features may interact with third-party services, including payment systems, authentication services, APIs, analytics services, and other external resources.

Such services are governed by their own terms and policies.

Nevigen.com does not control third-party services and does not guarantee their continuous availability.

12. Site Availability

We aim to provide stable access to Nevigen.com but do not guarantee uninterrupted or completely error-free availability of the Site.

Access to the Site or certain features may be temporarily restricted due to maintenance, updates, troubleshooting, actions of infrastructure providers, or circumstances beyond our reasonable control.

13. Limitation of Liability

The Site, its materials, and software products are provided subject to the terms applicable to the relevant product or service.

Users are responsible for selecting appropriate software products, complying with system requirements, maintaining backups of their websites and data, and for the consequences of modifications they independently make to software or website configurations.

To the maximum extent permitted by applicable law, Nevigen.com shall not be liable for indirect damages, loss of profits, loss of data, or business interruption resulting from the use of or inability to use the Site, a software product, or a third-party service.

Nothing in these Terms limits any rights that cannot lawfully be limited under applicable law.

Personal data is processed in accordance with the Nevigen.com Privacy and Personal Data Protection Policy.

15. Changes to These Terms

Nevigen.com may update these Terms from time to time, including as a result of changes to Site functionality, services, or legal requirements.

The current version of these Terms will be published on this page together with the date of the latest update.

Continued use of the Site after changes take effect means that the current version of these Terms will apply to further use of the Site.

16. Governing Law

These Terms are governed by the laws of Ukraine unless otherwise required by mandatory provisions of applicable law.

Any disputes that cannot be resolved through negotiations shall be handled in accordance with applicable law.
