RETURN AND EXCHANGE POLICY
These Terms define the procedure for order cancellation, refunds, handling of claims, and technical requests related to digital products and services purchased through Nevigen.com.
Nevigen.com digital products include software extensions, components, modules, plugins, licenses, software files, and other digital materials supplied electronically.
1. Cancellation Before the Product Is Provided
The purchaser may cancel an order before the digital product begins to be provided, provided that the product has not yet been supplied and access to its download or use has not been made available.
In such a case, the amount paid will be refunded in accordance with applicable law and the technical capabilities of the payment system used.
2. Time at Which a Digital Product Is Provided
Payment of an order does not always mean that the digital product is provided immediately. There may be a delay between processing of the payment by the payment provider and confirmation of the payment by Nevigen.com.
A digital product is considered provided when the order in the Nevigen.com information system receives the status “Paid” and the user is given access to download the purchased software product from the website.
Information about changes to the order status is sent to the email address provided when placing the order or specified in the user's account.
If the user has enabled additional notification channels on Nevigen.com, information about changes to the order status may also be sent through available communication methods, including messaging services.
The method and availability of such notifications depend on the services enabled by the user and the settings of their account.
If a license key, activation code, or other information is additionally required to use the product, it will be provided in accordance with the terms applicable to the relevant product.
Information concerning changes to the order status, provision of download access, generation of license keys, file downloads, and other actions related to receiving the digital product may be recorded by Nevigen.com information systems.
3. Commencement of Digital Product Delivery
For most Nevigen.com digital products, delivery begins after payment has been confirmed and the corresponding order status has been changed to “Paid”.
From this moment, the user is technically able to download the purchased digital product from Nevigen.com.
By placing an order and agreeing to the immediate provision of the digital product after payment confirmation, the purchaser confirms their consent to the commencement of digital content delivery after the order status changes to “Paid” and access to download the product has been enabled.
The purchaser also confirms that they have been informed of the possible loss of the right to withdraw from a distance contract after delivery of the digital product has begun, where provided by applicable law.
4. Refunds After a Digital Product Has Been Provided
After delivery of a conforming digital product has begun, a refund solely because the purchaser changed their mind, no longer needs the product, selected the wrong product, or expected functionality that was not stated in the product description may not be available in cases provided by applicable law.
This provision does not limit any rights granted by applicable law in the event that the digital product is not provided, materially fails to conform to its stated characteristics, or other legal grounds for a claim exist.
5. Conformity With Stated Functionality
A software product is considered to conform to its stated characteristics if it performs the functions described for that product on Nevigen.com, provided that the published system requirements, compatibility requirements, and conditions of use are observed.
Product performance is assessed against the functionality expressly stated for that product.
A user's subjective expectations, assumed capabilities, or functions that were not stated in the product description, documentation, or demonstration version do not constitute a defect or non-conformity of the software product.
In particular, the following do not by themselves constitute grounds for considering a product non-conforming with its stated functionality:
- an expectation that the product should operate differently;
- an assumption that a feature exists when it was not stated;
- an individual interpretation of how the product should operate;
- requests to change the existing product logic;
- requests to add new functionality;
- requests to adapt the product to a user's individual business logic or the specific characteristics of a particular website.
Before purchasing a product, the user should review its description, purpose, stated functionality, compatibility information, and system requirements.
If a particular feature is essential to the user and is not expressly stated in the product description, the user is encouraged to confirm its availability with support before purchasing the product.
6. Identification and Correction of Errors
If a user believes that a product does not perform one of its expressly stated functions, they may contact Nevigen.com support and describe the issue.
Nevigen.com will review the request and determine the cause of the issue.
If an error in the software product itself is confirmed, Nevigen.com will correct it by fixing the product, issuing an update, or using another technically appropriate method.
Confirmed product errors are corrected without additional charge within the terms of a valid license.
If the issue is caused not by an error in the software product but by its installation, configuration, or use, support may provide the user with recommendations for correct configuration and operation of the product within its stated functionality.
Incorrect configuration, user error, or insufficient understanding of how the product operates does not constitute a software defect if the stated functionality is available after correct installation and configuration.
7. Technical Support
Technical support is provided in relation to the stated functionality of the purchased product.
As part of technical support, Nevigen.com may:
- help identify the cause of an issue;
- provide recommendations for product installation and configuration;
- explain how the functions provided by the product are used;
- reproduce and investigate a suspected error;
- correct a confirmed error in the software product;
- provide a correction as part of a product update.
Technical support does not include free custom development, modification of the intended product logic, creation of new functions, integration with services for which compatibility was not stated, or adaptation of the product to the individual requirements of a particular website.
Where technically possible, such work may be provided as a separate paid service.
8. Product Improvement Requests
Nevigen.com welcomes suggestions for the development and improvement of its software products.
A request for a new feature, interface change, modification of existing logic, or extension of product capabilities is treated as a product development suggestion rather than a defect correction request where the requested capability was not previously included in the stated functionality.
If a proposed feature is generally applicable, consistent with the purpose of the product, and potentially useful to other users, Nevigen.com may decide to include it in a future version of the product.
The decision whether to implement such a suggestion, the method of implementation, and the release schedule remain at the discretion of the developer unless otherwise separately agreed with the user as part of custom development.
9. Software Product Updates
During the validity period of the license for the relevant domain, the user receives access to released updates of the purchased software product without additional charge, unless otherwise expressly stated in the terms applicable to a particular product.
Updates may include:
- corrections of identified errors;
- stability and compatibility improvements;
- changes required to support current versions of Joomla, JoomShopping, or other software environments;
- improvements to existing functionality;
- new functionality that the developer decides to include in the relevant version of the product.
Free access to updates during the license period does not create an obligation to implement individual requests or any user request for additional functionality.
Users are encouraged to install available updates in a timely manner, particularly where they are required to correct an identified error, maintain compatibility or security, or ensure correct operation of the product.
10. Free Software Products
Certain Nevigen.com software products may be provided to users free of charge.
Free software products are provided on an “as is” basis within the scope of their stated functionality. The user independently decides whether to install and use such products.
Because no fee is charged for such products, the provisions of these Terms concerning refunds of amounts paid do not apply to free software products.
Provision of a free product does not create an obligation for Nevigen.com to provide individual technical support, custom modifications, adaptation to a particular website, or additional functionality unless otherwise expressly stated on the relevant product page.
Nevigen.com may issue fixes, updates, and new versions for free products. However, provision of a free product does not by itself create an obligation to maintain its continuous development, update it indefinitely, or ensure compatibility with future versions of third-party software unless such obligations are expressly stated.
If separate support, update, or usage terms are stated on the page of a particular free product, those product-specific terms will apply.
11. Issues Not Caused by the Purchased Product
Problems caused by circumstances outside the product itself are not considered defects of the purchased software product, including:
- incompatibility with third-party software or extensions where such compatibility was not stated;
- modifications to the product source code made by the user or third parties;
- non-standard modifications to Joomla, JoomShopping, templates, or other website components;
- incorrect installation or configuration;
- a server or website environment that does not meet the published system requirements;
- changes to, restrictions on, or discontinuation of third-party APIs or services;
- use of a version of Joomla, JoomShopping, PHP, or other software for which compatibility was not stated;
- conflicts with third-party extensions or custom modifications for which compatibility was not stated.
Where technically possible, diagnostics, adaptation, or modification of the product for a user's individual website configuration may be offered as a separate paid service.
12. Incorrect Product Selection
Before purchasing a product, the user should review its description, purpose, stated functionality, system requirements, and compatibility.
If a demonstration version or demonstration website is available on the product page, users are encouraged to test the product before placing an order.
If the user has questions regarding compatibility, product operation, or the availability of a particular feature, they may contact support before making a purchase.
Selecting the wrong product, changes in the user's requirements after purchase, or the absence of a feature that was not stated in the product description do not by themselves indicate a defect in the digital product.
13. License and Domain Name
If a software product license is issued for a specific domain name, the terms governing its use, transfer, or replacement are defined in the License Agreement.
A change of domain name by the user does not by itself constitute grounds for a refund for a digital product that has already been provided.
14. Custom Development and Services
Cancellation and refund terms for custom development, configuration, integration, adaptation, or other services are determined with regard to the work actually performed and the terms agreed for the relevant order.
If custom work has already commenced with the customer's approval, the amount of work actually completed, costs incurred, and applicable legal requirements will be taken into account.
The result of custom development is assessed against the agreed technical specification or other agreed description of the scope and functionality of the work.
Customer requests that were not included in the agreed scope of work, technical specification, or otherwise confirmed requirements are not considered defects in the result of custom development.
Additional functions, changes to operating logic, and other requirements arising after the scope of work has been agreed may be performed as separate additional work.
